1. About these terms

These Terms of Service ("Terms") govern your access to and use of the website apprendre-tamazight-kabyle.com ("the Service"), operated by Mohand Aoudia ("we", "us", "our"), Malmö, Sweden.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. What the Service is

Apprendre Tamazight Kabyle is a trilingual (French / English / Arabic) web platform for learning, documenting, and preserving the Kabyle language.

The Service includes:

  • A dictionary of verified Kabyle words and translations.
  • A translator (French / English / Arabic to Kabyle).
  • A contributor system for submitting new words to a review queue.
  • A reviewer workflow for native Kabyle speakers.
  • Audio recordings of pronunciation.
  • (Future) Ingestion of documents, audio, and video.

3. Access tiers

3.1 Readers (free)

Anyone may access the public dictionary, search verified words, view translations, and listen to audio. No account is required for basic reading.

3.2 Contributors (free, account required)

To submit words, audio, or other content to the review queue, you must:

  • Create an account.
  • Accept these Terms.
  • Accept the Contributor Agreement (see CONTRIBUTOR-AGREEMENT.md).

3.3 Reviewers (invitation only)

Native Kabyle speakers may be invited as reviewers. Reviewers must accept a separate Reviewer Agreement. Reviewers can approve, reject, or question submissions.

3.4 Licensees (paid)

Companies and developers who wish to:

  • Use the source code,
  • Access bulk data,
  • Build derived products,
  • Use an API,

4. Acceptable use

You agree NOT to:

  • Scrape, crawl, or bulk-download the dictionary, audio, or any data from the Service.
  • Copy, redistribute, resell, or sublicense the data or code.
  • Use the Service to train machine learning models that will be sold or used commercially.
  • Build a competing dictionary, translator, or language platform using data extracted from the Service.
  • Reverse-engineer, decompile, or attempt to extract source code.
  • Bypass authentication, rate limits, or access controls.
  • Upload malware, viruses, or harmful content.
  • Submit content you do not have the right to submit.
  • Impersonate another person or misrepresent your identity.
  • Use the Service to harass, threaten, or harm others.
  • Violate any applicable law.

5. Your content

When you submit content (words, translations, examples, audio, video, documents), you:

  • Confirm you have the right to submit it.
  • Accept the Contributor Agreement, granting us a broad license to use, modify, publish, and commercially exploit the content.
  • Understand that verified content becomes part of the permanent dictionary and cannot be removed from the language record.

You retain the right to:

  • Be credited (unless you choose to be anonymous).
  • Withdraw a submission before it is verified.

You do NOT retain the right to:

  • Withdraw a verified entry from the dictionary.
  • Revoke commercial licenses already granted to third parties.

6. Intellectual property

All content on the Service is owned by us or our contributors and is protected by copyright and other intellectual property laws.

The Kabyle language itself is not owned by anyone. We only claim rights over our specific compilation, translations, audio recordings, review history, and software.

7. Accounts

You are responsible for:

  • Keeping your password secure.
  • All activity under your account.
  • Providing accurate information.

We may:

  • Suspend or terminate accounts that violate these Terms.
  • Remove content that violates these Terms.
  • Refuse service to anyone at our discretion.

You may:

  • Delete your account at any time.
  • Request export of your personal data (see Privacy Policy).

8. Availability and changes

We provide the Service "as is" and "as available". We do not guarantee:

  • Uninterrupted or error-free operation.
  • That all entries are linguistically perfect.
  • That the Service will always be available.

We may:

  • Modify, suspend, or discontinue the Service at any time.
  • Change these Terms. Significant changes will be announced with reasonable notice.

Commercial use of the code, data, or API is not permitted without a paid license. For licensing inquiries:

The Service is provided for educational and cultural purposes. We do not guarantee the accuracy of every translation or audio recording. Kabyle has significant regional variation, and no single authority owns the language.

You use the Service at your own risk.

11. Limitation of liability

To the maximum extent permitted by Swedish and EU law, we are not liable for:

  • Indirect, incidental, or consequential damages.
  • Loss of data, profits, or business opportunities.
  • Any harm arising from use of the Service.

Our total liability is limited to the amount you paid us in the last 12 months (typically zero for free users).

12. Governing law and jurisdiction

These Terms are governed by the laws of Sweden. Disputes are subject to the exclusive jurisdiction of the courts of Malmö, Sweden.

Before litigation, both parties agree to attempt good-faith negotiation.

Our handling of personal data is described in the Privacy Policy (PRIVACY-POLICY.md). By using the Service, you consent to that processing.
