Project: Apprendre Tamazight Kabyle Domain: apprendre-tamazight-kabyle.com Version: v1 Effective date: [TO BE CONFIRMED] Last updated: 2026-09-24 Project owner: Mohand Aoudia, Malmö, Sweden Contact: aoudiamohand70@gmail.com

DRAFT — This document is a starting point. Before public launch and before accepting real contributions, a Swedish/EU lawyer must review and finalize it.

1. Purpose of this agreement

This Contributor Agreement ("Agreement") governs the rights you grant to Apprendre Tamazight Kabyle ("the Project", "we", "us") when you submit any content to the platform.

By submitting content, you accept this Agreement in full. If you do not accept it, do not submit content.

This is the most important legal document of the project. Without it, we cannot legally verify, store, or commercialize your contributions. Read it carefully.

2. Who this applies to

This Agreement applies to anyone who submits content, including:

  • Words, expressions, and translations (Kabyle, French, English, Arabic, or any dialect).
  • Example sentences.
  • Audio recordings (pronunciation).
  • Documents, images, or videos (as sources).
  • Regional variants and notes.
  • Any other material submitted to the platform.

It applies whether the submission is made:

  • Manually (typing a word).
  • By uploading a file.
  • By recording audio.
  • By any future ingestion method.

3. What you grant us

3.1 The license

By submitting content, you grant Mohand Aoudia (the project owner) a:

Perpetual, worldwide, irrevocable, royalty-free, transferable, sublicensable license to:

  • Use, reproduce, store, and display your submission.
  • Modify, adapt, and create derivative works.
  • Publish and distribute it.
  • Commercially exploit it in any form.
  • Relicense it to third parties, including under commercial terms.

3.2 Why this is necessary

The Project is a commercial platform. It plans to:

  • Offer free access to the dictionary for readers.
  • Sell commercial licenses to companies and developers.
  • Grant paid API access.
  • Partner with institutions.

Without the right to commercially exploit your submissions, none of this is legally possible. Every user-generated-content platform that makes money (Wikipedia, YouTube, Facebook, Stack Overflow) uses a similar clause.

3.3 Sublicensing to third parties

You agree that we may sublicense your content to:

  • Commercial licensees of the data.
  • Research institutions.
  • Partner platforms.
  • Successors or assignees of the project.

Sublicensing does not give third parties rights to your personal data. Only to the content itself (words, audio, examples).

4. What you keep

You retain:

4.1 Moral rights (where applicable)

Under Swedish and EU law, you retain moral rights to be identified as the author of your contribution (unless you choose to remain anonymous) and to object to derogatory treatment. These rights cannot be waived.

4.2 Attribution

You will be credited for verified submissions unless you explicitly choose to remain anonymous at the time of submission.

Attribution appears:

  • On the word's page (contributor name, date).
  • In audit logs.
  • In optional data exports that include source metadata.

4.3 Right to withdraw before verification

You may withdraw a submission before it is verified into the permanent dictionary. Once verified, the entry becomes part of the language record and cannot be removed.

4.4 Your personal data

Your email, phone, and any other personal data are governed by the Privacy Policy (PRIVACY-POLICY.md), not by this Agreement. You can delete your account at any time.

5. What you do NOT retain

You do NOT retain:

  • The right to withdraw a verified entry from the dictionary.
  • The right to revoke commercial licenses already granted.
  • The right to restrict how we display your contribution (beyond choosing to be anonymous at submission time).
  • The right to claim exclusive ownership of the compilation.

The Kabyle language itself is not owned by anyone. Your contribution is one record in a larger community project.

6. Your warranties

By submitting content, you confirm that:

  1. You have the right to submit it. You own the content or have permission from the owner.
  2. It does not infringe third-party rights. No copyright, trademark, or privacy violations.
  3. It is accurate to the best of your knowledge. You are not knowingly submitting false information.
  4. You have the consent of any speakers recorded in audio or video submissions.
  5. It does not contain illegal content. No malware, hate speech, or illegal material.
  6. You are not violating any confidentiality obligation. You are not sharing a private document without permission.
  7. You are at least 16 years old (or have parental consent).

If any of these are false, you accept full legal responsibility.

7. Content types and special rules

7.1 Words and translations

  • Submitted to DB1 (candidate database).
  • Reviewed by native speakers.
  • If verified, promoted to DB2 (permanent dictionary).
  • You will be credited on the word's page unless you opt out.

7.2 Audio recordings

  • You confirm the speaker consented to the recording and to its use on a public platform.
  • If the speaker is different from you, you must have their written consent (kept privately, not uploaded).
  • Audio may be used in the pronunciation library, in research, and in commercial licenses.

7.3 Documents, images, videos

  • You confirm you have the right to share them.
  • Do not upload copyrighted material you do not own.
  • Documents may be used for extraction (OCR, text extraction) but the original files will not be published without your permission.

7.4 Regional variants and notes

  • Treated as content under the same license.
  • May be merged with existing entries.

8. Review and verification

8.1 No guarantee of verification

Submitting content does not guarantee it will be verified. Reviewers may approve, question, or reject any submission at their discretion.

8.2 Reviewer discretion

Reviewers are native Kabyle speakers appointed by the project owner. Their decisions are final for the purposes of the platform.

8.3 Dispute

If you disagree with a reviewer's decision, you may:

  • Submit a clarification.
  • Request re-review.
  • Contact the project owner.

You may not demand verification.

9. Anonymity

You may request to remain anonymous at submission time. If you do:

  • Your name will not appear on the word's page.
  • We still store your account ID internally (for legal and audit purposes).
  • You cannot later demand that your name be added or removed without verifying your identity.

10. Rate limits and abuse

Contributors are subject to rate limits (see docs/06-governance.md). Abuse may result in:

  • Temporary suspension.
  • Permanent ban.
  • Removal of contributions (if they violate warranties).

11. Changes to this Agreement

We may update this Agreement. When we do:

  • The version number increases (v1 -> v2, etc.).
  • New submissions fall under the new version.
  • Existing submissions remain under the version they accepted.

You will not be asked to re-accept for already-verified contributions.

12. Governing law

This Agreement is governed by Swedish law. Disputes are subject to the exclusive jurisdiction of the courts of Malmö, Sweden.

13. Severability

If any part of this Agreement is found unenforceable, the rest remains in force.

14. Acceptance

By submitting content to Apprendre Tamazight Kabyle, you confirm:

  • I have read this Contributor Agreement.
  • I accept its terms in full.
  • I confirm the warranties in section 6.
  • I understand that verified contributions become permanent.

Your acceptance is recorded with:

  • Your account ID
  • Date and time of acceptance
  • The version of this Agreement (v1)

End of Contributor Agreement.
